1. Acceptance of Terms
By accessing or using the TotalServe Plumbing website (totalserveplumbing.com) or submitting a service request, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.
2. Description of Service
TotalServe Plumbing is a referral and dispatch service that connects homeowners with independent, licensed plumbing contractors. TotalServe does not employ plumbers, perform plumbing work, or guarantee the quality or outcome of any work performed by contractors in our network.
We act solely as an intermediary between homeowners and independent plumbing professionals. All plumbing work is performed by independent contractors who are solely responsible for their services.
3. No Warranty on Contractor Services
While TotalServe screens contractors for licensing and insurance before admitting them to our network, we make no warranty, express or implied, regarding the quality, timeliness, safety, or outcome of any plumbing services performed by contractors we refer. TotalServe is not liable for any damages, losses, or injuries resulting from the work of referred contractors.
4. User Responsibilities
By submitting a service request, you agree to:
- Provide accurate and truthful information about your plumbing issue and location
- Be available to receive communication from the matched contractor
- Conduct your own due diligence before allowing any contractor into your home
- Negotiate and agree on pricing directly with the contractor before work begins
5. No Fee to Homeowners
TotalServe’s referral service is provided free of charge to homeowners. We do not charge homeowners for matching them with a contractor. Our service is funded by fees paid by contractors in our network.
6. Contractor Independence
All contractors referred through TotalServe are independent professionals and are not employees, agents, or representatives of TotalServe Plumbing. TotalServe is not responsible for the actions, omissions, or conduct of any contractor.
7. Limitation of Liability
To the maximum extent permitted by applicable law, TotalServe Plumbing shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our service or from the services provided by referred contractors. Our total liability shall not exceed the amount you paid us, which is zero.
8. Indemnification
You agree to indemnify and hold harmless TotalServe Plumbing, its officers, directors, and employees from any claims, damages, or expenses arising from your use of our service or your violation of these Terms.
9. Privacy
Your use of TotalServe is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Modifications to Terms
TotalServe reserves the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of our service after changes are posted constitutes your acceptance of the updated Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration.
